Step three: Audit your state of the art analysis
Pull up your SOTA section. Now ask: If a competitor wanted to argue your device is outdated or inferior, could they do it using publicly available information you did not address?
Search for devices in your category launched in the past three years. Search for clinical guidelines published recently. Search for systematic reviews addressing your clinical indication.
If you find relevant information you did not cite or discuss, you have a SOTA gap. Notified Body auditors will find it. They will ask why you missed it and what it means for your device positioning.
The SOTA analysis is not background reading. It is competitive and clinical context that must inform your benefit-risk determination. If newer devices offer advantages you do not, you must explain why your device remains clinically acceptable. Silence on this point creates doubt.
Step four: Validate your literature search methodology
Look at your literature search protocol. Did you define search terms before searching, or did you adjust them to get the results you wanted?
Did you search multiple databases or only PubMed? Did you include grey literature, clinical trial registries, adverse event databases?
Did you document your selection criteria and apply them consistently? Can someone else replicate your search and arrive at the same result set?
Most importantly: Did you address negative findings? If studies show complications or limitations related to your device type, did you analyze them or exclude them without justification?
Notified Bodies check methodology rigor because biased literature searches produce biased clinical evaluations. If your search looks designed to avoid inconvenient data, the entire CER credibility suffers.
Step five: Test your benefit-risk determination logic
Read your benefit-risk section as if you opposed the device approval. Can you find logical gaps?
Do you claim benefits without quantifying them? Do you minimize risks by comparing to unrelated procedures? Do you discuss benefits for ideal patients while ignoring how real patient populations might respond?
A robust benefit-risk determination acknowledges uncertainty, contextualizes risks against clinical alternatives, and addresses patient subgroups separately when relevant. If your determination reads like marketing copy, it will not survive audit scrutiny.
The benefit-risk determination is not a conclusion. It is a structured argument that must hold up under challenge. Every statement needs supporting evidence. Every comparison needs context. Every claim needs qualification.
Step six: Assess PMCF plan alignment
Compare your PMCF plan to the gaps and uncertainties identified in your clinical evaluation report.
Does the PMCF plan actually generate data to address those gaps? Or does it describe generic post-market surveillance that could apply to any device?
If your clinical evaluation notes limited long-term data, does your PMCF include a study design to collect long-term outcomes? If you identified a specific patient subgroup with uncertainty, does your PMCF actively recruit from that subgroup?
